COURT DISMISSES APPLICATION TO STOP COURT CASE AGAINST FR JAN CZUBA

The Waigani Committal Court today ordered for the case against Higher Education, Research, Science and Technology secretary Fr Jan Czuba to precede saying that he is not immune to criminal prosecution.

Magistrate Seth Tanei made the ruling after Fr Jan made submissions to dismiss the proceedings against him

The submission was based on the Diplomatic and Consular Immunities Act that the committal court do not have the jurisdiction to deal with his case because of his diplomatic status.

Magistrate Tanei ordered that the charges were made in relation to matters concerning a government department and not with the consul hence dismissed the application.

Fr Jan was charged with eight counts of abuse of office and one count of misappropriation in relation to a fraud of K4.2 million fraud within the department.

The substantive matter will return on January 21, 2021 for arraignment.

Fr Jan is out on a K3, 000 police bail.
